It all started with a Master thesis-cooperation between the Chair of Corporate and Intellectual Property Law from Technical University of Munich (TUM) and the law firm Heuking Kühn Lüer Wojtek in Dusseldorf, Germany. Between Munich as the homebase of the German Patent and Trademark Office (DPMA) as well as the European Patent Office (EPO) and Dusseldorf as European largest jurisdiction in patent infringement there was something special to connect with in a new digital way. There are several software solutions on the market which may analyse patent documents due to their linguistic data content to identify and assort specific information. But there weren´t any deep-tech methods to teach a computer to understand inventions based on their related patent claims and the patent document as a whole. Moreover business demands in patent infringement proceedings and patent nullity action hasn´t been satisfied at all when it comes to digitalisation until now.
This Master thesis has filled the digital gap between the patent litigation market and the required technology. Both aspects were analysed, identified and developed in detail: The market pull and the technology push. The results are an AI-algorithm architecture, an AI-knowledge database and the quantitative consulting methods used in this context at Europe´s most important patent locations with their potential customers.
